Service Terms
a. Scope of Work
All services provided will be outlined in a written agreement, proposal, or service plan. Any modifications or additional requests outside the agreed scope may incur extra charges.
b. Client Responsibilities
Clients are expected to:
Provide accurate and timely information
Grant access to necessary accounts and assets (e.g., Google Ads, website CMS)
Approve or provide feedback within agreed timelines
c. Results & Performance
While we strive for the best possible results, digital marketing outcomes (such as leads, conversions, or rankings) cannot be guaranteed due to varying market factors beyond our control.
Fees & Payment
Pricing is agreed upon before the commencement of any project or retainer.
Payment terms are usually 50% upfront and 50% on completion unless stated otherwise.
Late payments may result in paused services or additional fees.
Cancellation & Termination
Either party may terminate ongoing services with 14 days’ written notice.
All work completed up to the termination date will be invoiced and payable.
Refunds are not available for completed work or retained services already delivered.
Intellectual Property
Clients retain ownership of all original materials provided.
Blue Elephant Digital retains ownership of strategy documents, frameworks, or templates unless otherwise agreed.
Final deliverables become the client’s property upon full payment.
Confidentiality
We respect your privacy. Any sensitive information shared with us will be treated as confidential and not shared with third parties without consent, except as required by law.
Limitation of Liability
Blue Elephant Digital shall not be liable for:
Loss of business, revenue, or data resulting from service use
Third-party platform changes (e.g., Google policy updates)
Delays caused by factors outside our control
Changes to Terms
We reserve the right to update these terms at any time. Any changes will be posted on this page with an updated revision date.
Governing Law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England.
